These terms apply to every purchase from Black Marlin Trading Company through this website. By placing an order you agree to them.

Orders

An order is accepted when we send the shipping confirmation, not when payment is taken. We may cancel an order before it ships if an item is out of stock, a price or description was listed in error, or we cannot verify the payment or delivery details. If we cancel, you get a full refund.

Pricing and payment

All prices are in US dollars. Prices, shipping rates and promotions can change without notice, but the price you see at checkout is the price you pay. Sales tax is added at checkout where it applies.

Shipping and returns

Delivery times, rates and what happens when something goes wrong are set out in our Shipping policy and Refund policy. Both form part of these terms.

Food products

Our products are packed foods. Read the label before use, and check the ingredient and allergen information on each product page if you have an allergy or intolerance. Store as directed on the pack. We are not responsible for products that have been stored, prepared or used contrary to the label.

Product information

We work to keep descriptions, images and pricing accurate. Photographs are a guide; natural products vary in colour and appearance from batch to batch. If we discover an error in a listing after you order, we will contact you before shipping.

Subscriptions

Recurring orders are governed by our Subscription policy.

Gift cards

Gift cards are not redeemable for cash and cannot be reloaded. They do not expire.

Intellectual property

The name Black Marlin Trading Company, our product names, logos, photography and site content belong to us. You may not reuse them without written permission.

Limitation of liability

To the extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the courts of St. Johns County, Florida.

Changes

We may update these terms from time to time. The version on this page at the time you order is the one that applies to that order.
